Terms of Service

These Terms of Service ("Terms") govern your use of the Pentire paint-by-stickers application for iOS and iPadOS ("Pentire" or "the app"), published by Solutionflare LLC ("we," "us," "our"). By downloading or using Pentire, you agree to these Terms. If you do not agree, please do not use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to download and use Pentire on Apple devices you own or control, for your personal, non-commercial enjoyment, subject to these Terms and the Apple App Store Terms of Service.

2. Your content and imported photos

Pentire lets you turn your own photos into sticker puzzles. You retain all rights to the photos you import. Imported photos are processed on your device and are not uploaded to us (see our Privacy Policy). You are responsible for ensuring you have the right to use any image you import — for example, you should not use photos that infringe someone else's copyright, privacy, or other rights.

3. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the app, except where permitted by law;
• Use the app to create, store, or share content that is illegal, infringing, or that violates the rights of others;
• Interfere with or disrupt the app, or attempt to circumvent purchase or licensing mechanisms;
• Resell, sublicense, or commercially exploit the app or its content without our written permission.

4. Purchases and subscriptions

Pentire is free to download and play. An optional upgrade, Pentire Plus, unlocks premium features — such as unlimited photo puzzles, additional difficulties, piece shapes, art styles, themes, and unlimited saved puzzles. Pentire Plus is offered as a one-time lifetime purchase or a monthly auto-renewing subscription; the current price is always shown in the app before you confirm a purchase.

• Billing. All purchases are processed by Apple through your App Store account. We never receive your payment details.
• Auto-renewal. The monthly subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel it at any time in your Apple Account settings (Settings → your name → Subscriptions) or from the "Manage Pentire Plus" screen inside the app. The lifetime purchase is a single payment and never renews.
• Restores. Reinstalled the app or switched devices? Use "Restore Purchases" in the app's Settings while signed in with the same Apple Account to regain Pentire Plus at no extra charge.
• If your subscription ends. Everything you have created or saved stays on your device and remains playable — lapsing only stops the creation of new premium content until you re-subscribe.
• Refunds. Purchases are handled by Apple; refund requests are made to Apple and are subject to Apple's policies (see reportaproblem.apple.com).

5. Intellectual property and feedback

The app, including its software, design, built-in artwork, themes, and the Pentire name and logo, is owned by Solutionflare LLC and protected by intellectual property laws. Except for the license granted above, no rights are transferred to you. Puzzles you create from the built-in library remain subject to this license; puzzles you create from your own photos use your own content.

If you send us suggestions, ideas, or feedback about the app, you agree we may use them freely — without restriction, attribution, or compensation — including to improve the app or develop new features.

6. Disclaimers

Pentire is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that on-device processing will produce a particular result for every photo.

7. Limitation of liability

To the maximum extent permitted by law, Solutionflare LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the app, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the app will not exceed the greater of (a) the amount you paid us for the app in the twelve months before the claim and (b) ten U.S. dollars (US$10). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case our liability is limited to the fullest extent permitted by law.

8. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Solutionflare LLC and its officers, members, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) content you import into the app, including any claim that a photo you used infringes or violates someone else's rights; or (c) your violation of any law or the rights of a third party in connection with your use of the app.

9. Termination

You may stop using the app at any time by deleting it. We may suspend or terminate your license to use the app if you materially breach these Terms (for example, by circumventing purchase mechanisms or misusing the app), or if we discontinue the app. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — survive. Termination does not entitle you to a refund from us; refunds are handled by Apple under Apple's policies.

10. Changes to the app and these Terms

We may update, change, or discontinue features of the app at any time, including the composition of the free tier and Pentire Plus (existing content you created always remains playable per Section 4). We may also update these Terms; when we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice in the app. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.

11. Apple-specific terms

These Terms are between you and Solutionflare LLC, not Apple. Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any maintenance, support, or product warranty obligations are ours, not Apple's, to the extent any apply.

12. Governing law and dispute resolution

These Terms are governed by the laws of the United States and the state in which Solutionflare LLC is organized, without regard to conflict-of-laws principles, except where the consumer-protection law of your place of residence requires otherwise.

Talk to us first. Before filing any claim, you agree to contact us at pentire-support@solutionflare.com and give us 30 days to try to resolve the dispute informally — most issues are fixed this way.

Binding arbitration and class-action waiver (U.S. users). To the extent permitted by law, any dispute that isn't resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and Solutionflare LLC each waive the right to a jury trial and to participate in a class action, class arbitration, or representative proceeding. You may opt out of this arbitration provision by emailing us within 30 days of first accepting these Terms with the subject "Arbitration Opt-Out". If this class-action waiver is found unenforceable for a particular dispute, then this arbitration section does not apply to that dispute.

13. General

If any provision of these Terms is held unenforceable, the remaining provisions stay in full effect, and the unenforceable provision will be enforced to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and the Apple App Store terms, are the entire agreement between you and us regarding the app.
